Funding Your Case

How will you fund your case?

Bains Solicitors offer representation under the Legal Aid scheme or alternatively we are regularly instructed on a private fee basis.

01.

At The Police Station

Advice and Assistance at the Police Station is covered by the Legal Aid Scheme, therefore anyone arrested or invited to attend a voluntary interview at a police station is eligible for legal aid. It is imperative that anyone who has to attend a PACE interview be legally represented and therefore you should exercise this right. Contact us to arrange a representative 01933 440000

02.

At Court

We also assist you making an application for legal aid in the Magistrates and/or Crown Court. Depending on your circumstances, you may be entitled to free legal advice and assistance.  Please contact us so that we can assess your suitability and make the necessary application on your behalf. Your eligibility is based on the nature of the charge you face (interests of justice test) and then your financial eligibility (means test).

In the Crown Court, if your disposable income is above £37,500 per annum, you will likely have to make a contribution towards your representation.  Contact our Crown Court team to discuss your options 01933 440000

03.

Private Representation

If you are not eligible for legal aid our private rates are competitive and can be tailored to the nature of your case. Please contact our fees team to discuss funding options for your case. Motoring/Road Traffic matters are sometimes not eligible to be funded through legal aid.  Please see our motoring section.

Bains Solicitors offer transparent fixed fee pricing so that there are no hidden costs and you are aware of the costs involved from the outset and can then plan for them.  We will provide you an estimate of costs at inception.

04.

Defence Costs Order

If you have paid privately for representation or made a contribution towards your legal aid and you are acquitted, we can assist with recovering some of your defence costs from the Government.  This can be explained in more detail by calling 01933 440000

Summary Only Private Motoring Cases Transparency

Some motoring matters will not be covered by the Legal Aid Scheme. With a view to transparency, we offer fixed fee motoring packages to fund your case. Contact our friendly team to discuss funding and talk you through our services.

Likely disbursements will be outlined in full before work is carried out. Payment before formal instruction of any experts is required.

Fees may be subject to change depending on complexities of the case, in which case a detailed quote will be provided.
